These are the rules for using Fall Line: who can use it, what you can post, how we moderate, and the limits of what we promise. Please read the safety section in particular.
3. Your content
“Your content” means anything you post: photos, YouTube links, captions, tips, comments, questions, answers, reports, polls, ratings and profile details.
You keep ownership of your content. By posting it, you give Fall Line a worldwide, non-exclusive, royalty-free license to host, store, copy, display, resize and format it, and to show it on Fall Line and in links and previews of Fall Line pages, for as long as it’s on the site. This license ends when you delete the content or your account, except for copies in backups for a limited time and content other riders have already responded to where removing it isn’t practical.
When you post, you promise that:
- you created it or have the rights and permissions needed to post it;
- anyone who can be clearly identified in a photo or video agreed to it being shared where that matters (for example, close-ups, or anyone under 18), and you don’t post photos of people in a way that embarrasses or targets them;
- it’s honest: reports and ratings reflect what you actually saw and think.
Video clips are hosted on YouTube, so YouTube’s own terms also apply to them.
4. Acceptable use and moderation
Keep it about skiing and riding, and treat other riders with respect. Don’t:
- harass, threaten, bully or post hateful content about anyone;
- post anything illegal, sexual, violent or dangerous, or that encourages others to break the law or a resort’s rules;
- post fake reports or ratings, spam, or advertising;
- share someone else’s personal information;
- post content that infringes someone’s copyright, trademark or other rights;
- try to break, overload or get around the security of the site, scrape it in bulk, or access accounts or data that aren’t yours.
Clips, tips, comments, polls, questions, answers and conditions reports have a report option. Use it to flag anything that breaks these rules. We may review, edit the presentation of, hide or remove any content, and warn, limit, suspend or close any account, at our discretion, including when we believe it’s needed to protect riders or Fall Line. We aren’t obliged to monitor everything posted and can’t check it all, so content from riders reflects their views, not ours.
6. Fall Line’s content and open data
The Mountain Score, rankings, “good for” picks and other ratings are our opinions, worked out from the data we have. They aren’t a guarantee of what you’ll find on the day.
Trail maps are built from OpenStreetMap data, © OpenStreetMap contributors, available under the Open Database License. Many photos are by other photographers under Creative Commons or similar licenses and are credited where they appear; those licenses, not these Terms, govern how you can reuse them. See where our data comes from.
Apart from that, the site’s design, text and code belong to Fall Line. You’re welcome to use the site and share links to it, but please don’t copy or republish it in bulk.
10. Disclaimers and limitation of liability
Fall Line is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties of any kind, express or implied, including that the site or its information is accurate, complete, current, reliable, uninterrupted or error-free, or fit for any particular purpose.
To the fullest extent the law allows, Fall Line and the people behind it are not liable for any indirect, incidental, special, consequential or punitive damages, or for any injury, loss or damage arising from your use of the site, your reliance on its information, content posted by others, or your activities on any mountain. Our total liability for any claim about Fall Line is limited to the greater of the amount you paid us in the 12 months before the claim or US$50. Some places don’t allow some of these limits, so they may not all apply to you.
You agree to cover Fall Line for claims and costs arising from content you post or your breach of these Terms, to the extent the law allows.
